Why New York City is above the New York rate

New York City's floor is set by New York State labor law, which sets a separate downstate rate. A local minimum wage can only ever raise the floor: federal law sets a national minimum, New York sets its own at $16.00, and a city ordinance or a regional rate stacks on top. Whichever number is highest for the place the work is done is the one your employer owes.
